The immigration management division under the Dong Nai City Police conducted an unannounced inspection of the company as part of efforts to detect and handle foreign nationals residing or working illegally in Vietnam, the municipal police announced on their portal on Sunday.

After reviewing documents and checking the company's actual workforce, inspectors found that the company had failed to fulfill its legal responsibilities when inviting, sponsoring and arranging entry, exit and residence for foreign nationals.

The 91 foreign workers had worked at the company for more than 90 days without work permits or documents confirming that they were exempt from the requirement.

The company was also found to have employed foreign nationals who did not meet the legal requirements.

The inspection team compiled records of administrative violations for handling the company and relevant individuals in accordance with the law.

The case serves as a warning to businesses employing foreign workers that failure to comply with immigration, residence and labor regulations can lead to serious legal consequences and affect labor management and public security.

The immigration management division urged businesses to review the legal documents of all foreign employees and allow them to work only after they have obtained work permits or confirmation that they are exempt from the requirement.

Companies must also fulfill their sponsorship and management responsibilities and promptly notify the authorities of employees leaving their jobs, termination of employment contracts or changes in residence status.

The division said it would continue coordinating with relevant agencies to step up inspections and follow-up checks and strictly handle violations.

Foreign guests’ temporary residence must be declared even for one-night stays in Vietnam

Vietnam's Ministry of Public Security has reminded accommodation providers that they must declare the temporary residence of foreign guests, including those staying for just one night.

Under Vietnam’s regulations, foreign nationals must have their temporary residence declared through the person directly managing or operating their accommodation.

Before accepting a foreign guest, accommodation providers must ask the guest to present a passport or other valid international travel document and relevant residence papers for verification before making the declaration.

The person responsible for declaring temporary residence is the accommodation's owner, legal representative or an authorized person.

The declaration must be made as soon as the foreign guest arrives, through the ministry's electronic temporary residence declaration system at https://tbltkbtt.bocongan.gov.vn.

If electronic submission is not possible, the responsible person must complete and submit a temporary residence declaration form to the commune-level police.

Accepting bookings through digital platforms does not remove accommodation providers' responsibility to declare foreign guests' temporary residence.

If a foreign guest cannot present a passport or another valid international travel document, or shows signs of violating immigration or residence laws, the accommodation provider must immediately notify the competent authorities.
