The government has issued Decree No. 371/2026/ND-CP on the recruitment and management of Vietnamese employees working for foreign organizations and individuals in Vietnam.
The decree replaces relevant provisions of Decree No. 152/2020/ND-CP, as amended by Decree No. 70/2023/ND-CP, and will take effect on November 15, 2026.
Under the new rules, foreign organizations and individuals must notify the competent management agency or organization when they need to recruit Vietnamese workers. The notice can be submitted in person, by post, or online and must specify the positions and number of workers needed.
Recruitment information must also be made public on the national employment exchange at vieclam.gov.vn, another legally established employment portal, or the organization’s official website.
Foreign organizations and individuals may recruit Vietnamese workers directly or request assistance from the competent management agency in screening and referring suitable candidates.
The requirement to publicly post vacancies is a notable change from previous regulations, which did not mandate such disclosure on the national employment exchange.
The decree also expands the use of digital procedures, allowing notices, dossiers, and reports to be submitted through official online channels, including email.
Employers must report hires within 10 working days
Foreign organizations and individuals must notify the competent management agency within 10 working days of signing an employment contract with a Vietnamese worker.
The notice must include the worker’s full name, personal identification number, job position, and starting date.
When an employment contract ends, the foreign employer must notify the management agency within 10 working days and state the reason for termination.
Tighter oversight of labor subleasing
The decree also introduces stricter requirements for labor subleasing companies.
Such companies must submit lists of Vietnamese workers subleased to foreign organizations and individuals within 10 working days of the sublease starting and file periodic reports before December 15 each year.
Foreign organizations and individuals using labor subleasing services must notify the management agency within seven working days of beginning to use the service.
The decree applies to foreign diplomatic missions and consular offices, representative offices of international organizations, intergovernmental bodies, regional and sub-regional organizations, representative offices of organizations under foreign governments, permanent offices of foreign news agencies and broadcasters, and registered foreign non-governmental organizations.
Foreign individuals working for these organizations who employ Vietnamese workers are also covered by the decree.
