Decree 59/2026 regulates how deportation is imposed as an administrative penalty and how foreign nationals are managed while awaiting removal from the country.
The decree applies to foreigners who commit administrative violations in Vietnam and are subject to deportation under the law.
It also covers individuals placed in administrative detention or escorted by authorities, as well as officials responsible for enforcing those measures.
Deportation may be imposed on foreign individuals who commit administrative offences within Vietnam’s territory, its contiguous zone, exclusive economic zone, and continental shelf.
The measure can also apply to violations committed on aircraft registered in Vietnam or ships flying the Vietnamese flag, in accordance with existing laws on administrative sanctions.
Foreigners subject to deportation must be informed of the reasons for the decision and receive the administrative penalty notice at least 48 hours before it is carried out.
They have the right to contact diplomatic or consular representatives of their country, request an interpreter when working with authorities, and seek a review of the deportation decision under Vietnamese law.
Those facing deportation may take their lawful property out of Vietnam and may file complaints in line with legal provisions, the government said.
