Decree 58/2026 amends regulations on security and order conditions for certain conditional business sectors, as well as rules governing the management and use of fireworks.
Previously, only organizations and enterprises under the Ministry of National Defense were permitted to research, manufacture, export, import, and supply explosive fireworks.
Under existing rules, the prime minister decided which defense ministry entities were authorized to conduct such activities.
The new decree transfers that authority to the ministers of public security and national defense.
The public security minister will decide which entities under the Ministry of Public Security are allowed to engage in activities related to explosive fireworks, while the defense minister will make corresponding decisions for entities under the Ministry of National Defense.
The decree also revises authority over the organization of explosive fireworks displays during major holidays.
Under the new rules, chairpersons of provincial-level People’s Committees will decide, based on local conditions, on holding fireworks displays during occasions including the Lunar New Year, the Hung Kings Commemoration Day, National Day (September 2), the Dien Bien Phu Victory anniversary (May 7), and Reunification Day (April 30) celebrations.
Previously, such cases required a decision by the prime minister.
For fireworks displays linked to national or international cultural, tourism or sporting events, as well as changes to firing range or duration, provincial-level authorities will also have decision-making power based on proposals from local cultural agencies.
The decree reduces the processing time for permits to transport fireworks and fireworks powder for production and business from five days to three days.
Transport permits will remain valid for a single shipment but will no longer need to be returned to the issuing authority after completion.
Licenses to purchase fireworks for business purposes will remain valid for 30 days, unchanged from current regulations.
